Marshall Speaks at Legal Malpractice & Risk Management Conference

New Orleans, La. – Nancy J. Marshall, a partner in Deutsch, Kerrigan & Stiles' New Orleans office, is speaking at the 11th Annual Legal Malpractice & Risk Management Conference. She will be on a two-person panel discussing the topic "The Plaintiff's Lost or Impaired Remedy: Issues of Proof Regarding Collectibility."
Valuing a plaintiff's claimed loss often turns on the issue of collectibility. Over the last year, the existing case law on the subject has been augmented by important decisions that provide guidance on how to analyze collectibility issues, what evidence can be considered and in what manner, who has the burden of proof, and what pretrial remedies are available. This panel will review those recent decisions and discuss the developing principles in this significant area of legal malpractice litigation, including the impact that insurance and other collateral sources (or lack thereof) may have on assessing "collectibility."
Ms. Marshall is co-head of Deutsch, Kerrigan & Stiles' professional liability & commercial law department and practices in the area of professional liability law and products liability law. In particular, she concentrates on defending legal malpractice claims, representing the endorsed insurer for the Louisiana State Bar, among other insurers. She was a member of the ABA Standing Committee on Lawyers Professional Liability from 2000-2003. Ms. Marshall also represents other professionals, including insurance agents and brokers, real estate brokers, nurses, nursing homes, home health care facilities, accountants and termite protection providers.
